Ease of doing business The Maharashtra government on Monday introduced a bill in the state assembly relaxing rules for shops and establishments with less than 10 persons. The bill proposes that such establishments will no longer require registration to operate, will be easier to open and close, and will be free from oversight on labor compliance.
Officials said all shops and establishments will have to comply with key labor laws such as the Minimum Wages Act and metered benefits. However, welfare facilities like cream or canteen will be left at the discretion of the employer with a minimum of 10 workers. Officials said that if the bill goes through, it will cut red tape and boost employment in small establishments. A senior government official said, "Those inspectors will be free from raj. In fact inspectors can focus on big installations." However, trade unions fear that this will make workers more vulnerable.
Sanjay Wadhavkar of the Hind Mazdoor Sabha said, "Basically there will be little labor compliance." There are 38 lakh establishments in Maharashtra. According to official data, about 13 lakh of these are less than 10 employees. The bill proposes that when an establishment of less than 10 workers is started, they will have to send a notice in the form of an online application and self-attested documents to a state-appointed facilitator. Nature of business and number of employees will also be part of the self-declaration. When the establishment is closed, it has to notify the facilitator within 30 days. The fact that registration is not required for establishments with fewer than 10 people means they will be exempt from oversight, officials said.
In establishments with more employees, inspectors may conduct site inspections to report compliance with regulations. Earlier this year, the state has revised the Contract Labor Act to substantially reduce the number of establishments covered under this law in the state.
